Terms of Service

1. Acceptance of Terms

By accessing or using WaiverKit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

WaiverKit provides a digital platform for creating, distributing, and storing waivers and consent forms. The Service includes waiver template creation, electronic signature capture, PDF generation, and secure document storage.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Subscriptions and Billing

WaiverKit offers free and paid subscription plans. Paid plans are billed monthly or annually through Stripe. You may cancel your subscription at any time, and access will continue until the end of the current billing period. Paid plans are marketed as including "unlimited" signed waivers under typical use. Sustained usage that materially exceeds typical operator volume (currently considered to be more than 10,000 signed waivers per calendar month for one account) may, after written notice and a reasonable transition period, require migration to a custom plan. WaiverKit will not retroactively bill prior usage.

5. User Content

You retain ownership of all waiver templates, collected signatures, and other content you create or upload through the Service. You grant WaiverKit a limited license to process and store this content solely to provide the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the Service.
  • Interfere with the proper functioning of the Service.
  • Upload malicious content, viruses, or harmful code.
  • Resell or redistribute the Service without authorization.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection laws in your jurisdiction.

8. Limitation of Liability

WaiverKit is provided "as is" without warranties of any kind. To the maximum extent permitted by law, WaiverKit shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Switzerland. Any disputes arising from these Terms shall be resolved in the courts of Switzerland.
